When people hear “ministry,” they often picture a traditional church. But your calling may look completely different. Faith-based ministries can take many forms. However, because each ministry is different, the activity itself doesn’t automatically determine the organization’s legal or tax structure. That’s why how you establish your ministry matters.

Before You Start a Christian Daycare, Ask This Question
If you’re researching how to start a Christian daycare or faith-based childcare center, you’re probably thinking about licensing, facilities, staffing, curriculum, enrollment, insurance, and funding. Those things matter. However, there’s another question that should come much earlier.
How will your Christian beliefs relate to the organization itself?
Will faith simply influence your personal motivation for opening the childcare center? Or will biblical teaching, prayer, Christian curriculum, religious instruction, ministry, and a defined statement of faith become fundamental parts of its purpose and operation?
Therefore, that distinction matters.
For example, a childcare business owned by Christians isn’t necessarily structured the same way as a childcare program operating as part of a qualifying church or integrated ministry.
Before you build the program, understand the foundation underneath it.
501(c)(3) vs. 508(c)(1)(A): What Faith Leaders Should Understand
However, this is where many ministry founders become confused.
Section 501(c)(3) establishes federal tax-exemption requirements for qualifying religious, charitable, educational, and other organizations.
Section 508(c)(1)(A) provides an important exception to the requirement to apply for recognition of exemption for churches, their integrated auxiliaries, and conventions or associations of churches. Churches that meet applicable requirements can therefore be automatically considered tax-exempt without filing Form 1023 for IRS recognition.
For that reason, it’s worth understanding the difference before automatically following the same formation path used by a typical nonprofit.
Don’t Assume Every Faith-Based Organization Is the Same
Likewise, a church, Christian school, outreach ministry, childcare center, missionary organization, and charitable nonprofit can involve different legal considerations. That’s precisely why good counsel matters. Therefore, the question shouldn’t simply be, “How do I get a 501(c)(3)?”
A better question is, “What structure properly fits the faith-based organization God has called me to build?”
Why Your Ministry’s Structure Matters
Most importantly, the decisions you make at the beginning can affect far more than paperwork. Your organizational structure can intersect with:
Governance
Who controls the organization and how are important decisions made?
Religious identity
Do your governing documents clearly establish the organization’s religious beliefs, purposes, and practices?
Tax-exempt status
What federal and state rules apply to your ministry?
Donations
How will contributions be received, documented, and managed?
Where Faith, Operations and Legal Structure Meet
Employment
How will your faith and mission affect hiring and employment decisions?
Property and operations
Who owns or leases facilities, and what regulations apply to your activities?
When Your Ministry Begins to Grow
Growth
What happens when your small ministry becomes a much larger organization?
Of course, these questions aren’t meant to discourage someone from answering God’s call.
They’re reasons to build wisely from the beginning.
How to Start a Faith-Based Ministry Without Becoming an Expert Yourself
Here’s something we want every ministry founder to understand, you don’t have to know all of this.
You don’t have to spend weeks trying to interpret tax code. There’s no need to know which documents come first or become an expert in church or nonprofit structure before answering the calling God has placed on your heart. That’s why experienced counsel can make an enormous difference.
Proverbs 15:22 reminds us: “Plans fail for lack of counsel, but with many advisers they succeed.”
Seeking counsel isn’t a lack of faith. Sometimes it’s simply good stewardship.
